"School Ground Violations"

CRIMINAL TRESPASS IN THE 1ST DEGREE: RCW 9A.52.070 - This is a gross misdemeanor in which a person knowingly enters or remains unlawfully in a building.

CRIMINAL TRESPASS IN THE 2ND DEGREE: RCW 9A.52.080 - This is a misdemeanor in which a person knowingly or remains unlawfully in or upon premises of another.

LOITERING ON SCHOOL GROUNDS: RCW 9.20.030 - This is a misdemeanor in which a person not enrolled as a student or parent or guardian of a student without lawful purpose loiters about the building or buildings of a private or public school at a time when school is in session or organized activities are in progress.

ENCOURAGING FIGHTING: RCW 9.20.010 - Any person fighting or encouraging others to fight in any public place is guilty of a misdemeanor.

POSSESSING DANGEROUS WEAPONS ON SCHOOL FACILITIES: RCW 9.41.280 - This is a gross misdemeanor in which it is unlawful for a person to carry onto, or to possess on, public or private elementary or secondary school premises, school provided transportation or areas of the facilities while being used exclusively by public or private schools.

CRIMINAL GANG INTIMIDATION: RCW 9A.46.120 - This is a class C Felony in which a person threatens another person with bodily injury, because the other person refuses to join or has attempted to withdraw from a gang, and if the person who threatens the victim or the victim attends or is registered in a public or alternative school.

"Gang" is defined as being a group which: (a) consists of three or more persons; (b) has identifiable leadership; and (c) on an ongoing basis, regularly conspires and acts in concert mainly for criminal purposes.

ATTENDANCE MANDATORY: RCW 28A.225.010 - All parents in this state of any child eight years of age and under eighteen years of age shall cause such child to attend the public school of the district which the child resides and the child shall have the responsibility to attend full time.

INTIMIDATING ANY ADMINISTRATOR, TEACHER, CLASSIFIED EMPLOYEE, OR STUDENT BY THREAT OF FORCE OR VIOLENCE UNLAWFUL: RCW 28A.635.100 - It shall be unlawful for any person singly or in concert with others, to intimidate by threat of force or violence any administrator, teacher, classified employee, or student of any common school who is in the peaceful discharge or conduct of his or her duties or studies.

PURCHASING, POSSESSING, OR OBTAINING TOBACCO BY PERSONS UNDER THE AGE OF EIGHTEEN: RCW 70.155.080 - A person under the age of eighteen who purchases or attempts to purchase, possesses, or obtains or attempts to obtain cigarettes or tobacco products commits a class 3 civil infraction. The penalty is $95 fine.
